Note on IURC Jurisdiction for Solar Projects

Independent solar generators in Indiana must file a petition for declination of IURC jurisdiction under Ind. Code § 8-1-2.5-5 before construction. A declination order is not “no regulation” — it means the IURC determined that full regulatory oversight of the independent generator was not in the public interest, given FERC oversight of wholesale power sales.
